Teeofftimes.co.uk Booking Terms and Conditions
Effective date – Thursday, October 29, 2015
At Teeofftimes.co.uk, you can book tee times with our extensive selection of golf clubs and golf courses throughout the UK and the Republic of Ireland on our website, www.teeofftimes.co.uk (the site). Teeofftimes.co.uk is owned and operated by BRS Golf Limited (we), organised and existing under the laws of Northern Ireland, under company number NI606497 and with its registered office at Centrepoint, 2nd Floor, 24 Ormeau Avenue, Belfast BT2 8HS, Northern Ireland.
1. Contract with the Golf Club or Golf Course
1.1 Teeofftimes.co.uk acts as agent on behalf of the golf clubs and golf courses listed on our site. So when you make your online tee time booking, your contract is with the golf club or course and the rules and regulations of the club or course apply. Club and course rules vary and so we can provide you with a copy of the club or course’s rules on request.
2. What is Included in your Booking
2.1 Your tee time booking is a booking for you to play a round of golf at a particular golf club or course at a particular time. Sometimes the price of the booking may include tea, coffee, breakfast, lunch, yardage book, bags or other extras, but only if advertised as part of the tee time price on our site.
3. Accuracy of Information
3.1 General information about the golf clubs and courses advertised on our site are provided to us by the golf clubs and courses. Whilst we try to ensure that this information is correct and up-to-date by regularly contacting the clubs and courses, we rely on the golf clubs and courses providing us with accurate information. Accordingly, we do not accept any liability whatsoever to you in respect of any inaccurate or erroneous information provided, except to the extent caused by our negligence or fraud.
4.1 Prices for tee times vary according to the standard, quality and variety of the course as well as the golf club location and facilities. Price savings that we advertise for a particular tee time at a particular golf club or course are price discounts on the standard seasonal prices offered by that golf club or course.
4.2 Prices are liable to change at any time, but changes will not affect a booking in respect of which you have received a Booking Confirmation (see section 6 below).
5. Availability of tee times
5.1 All tee times offered on our site are supplied to us by the listed golf clubs and courses and we are in regular contact with the clubs and courses to ensure that we have an accurate display of availability. The tee times advertised are a mixture of live available tee times and request tee times which have to be checked by our office with the golf club or venue on your behalf. Therefore, we cannot guarantee in all cases that the tee time you select will be available.
5.2 Individual tee times are usually available for up to four players, so if your booking includes more than four players, you will need to select more than one tee time. Note that tee times are based on playing in four-balls and therefore you may be paired up with other golfers on the day.
5.3 Hot Deals are limited to two tee times a day at a limited number of clubs and are sold on a first-come-first-served basis. These tee times will be the lowest price points of the day for specific times. Once the tee time has been sold it will be removed from the website and reappear the following day (if it hasn’t already been sold).
5.4 The price point for Hot Deals are not transferable to other or additional bookings/times. If an additional tee time is required for groups of more than four, this will be charged at rate that is advertised for this tee time on Teeofftimes.co.uk and not at the Hot Deals price. If a Hot Deal tee time needs to be cancelled please refer to the cancellation policy in section 8. Hot Deals tee times that were cancelled due to course closure will be refunded in accordance with our Inclement Weather Policy.
5.5 Promotional codes, gift vouchers and Rewards Points can all be redeemed against Hot Deals bookings as per our normal booking conditions.
6. How to Book a tee time
6.1 To book a tee time, you must be 18 years or over. By making the booking you confirm that you and the other players on whose behalf you are making the booking accept the Terms and that you will inform the other players of the confirmation details and any other relevant information. For booking purposes you will be known as the “lead name” and you are responsible for making all payments due in respect of the booking.
6.2 To book a tee time on our site, please select a golf club or course and then choose one of the available tee times for that club or course on the date you require. You will then be given a summary of the club or course that you have selected, the tee time date and time and the price per person. You will be asked to select the number of players requiring the requested tee time and, if this is your first booking with Teeofftimes.co.uk, to give your name address, telephone number and email address and nominate a password. This personal information will be stored for future bookings (see clause 12 below). You can book for up to four players on our site for a single tee time.
6.3 To proceed with your booking request, we require advance payment of the total price for all players included in your booking request (the Booking Payment) by debit or credit card (see below for the debit and credit cards that we accept and our handling charges).
6.4 By entering your payment details you confirm that the credit or debit card that is being used is yours or that you have been specifically authorised by the owner of the credit or debit card to use it. All credit and debit card holders are subject to validation checks and authorisation by the card issuer. If your card issuer refuses to authorise payment, we will not be able to process your booking.
6.5 All payments made to Teeofftimes.co.uk are held on behalf of the golf club or course. Please ensure that you check carefully all the details of your booking request including venue, date, tee time and price before you make payment. If any of the details are incorrect, you can go back to the previous page and re-enter the information. Your booking request constitutes an offer by you to purchase a tee time.
6.6 We accept the following credit or debit cards: Visa, Mastercard, American Express, Switch, Delta and Connect. There is a £1 per golfer fee for all transactions. Cheques are not accepted.
6.7 Once you have given your payment details, you will be given a receipt confirming your booking request. Please note that the receipt is not confirmation that your tee time request has been accepted. Once your booking request has been accepted, we will then send you an email confirmation of your booking on behalf of the golf club or course ("Booking Confirmation"). With some booking requests, we have to check availability with the golf club or course before we can send you the Booking Confirmation which can take up to 2 hours during normal working hours (Monday to Friday 9am to 5pm; Saturday, Sunday & public holidays 9am to 4pm). Outside of working hours you will be sent your Booking Confirmation by 10am the next working day and 10am at the weekend. If you have booked to travel within 2 hours the booking will be fast-tracked by our Customer Service team. A binding contract with the club or venue is only formed when we issue the Booking Confirmation (a "Booking").
6.8 If the golf club or course is unable to provide the tee time you request, but has a tee time within forty minutes of your requested tee time for the same price (a Substitute Tee Time), you hereby authorise us to accept the Substitute Tee Time on your behalf. The Substitute Tee Time will be confirmed in your Booking Confirmation.
6.9 If the golf club or course is unable to provide the tee time you request or a Substitute Tee Time, we will contact you to see if we can find an alternative. If we can’t find a suitable alternative, we will refund your payment to the credit or debit card with which you made payment as soon as possible and in any event within 30 days.
6.10 Your Booking Confirmation is evidence of your Booking and must be presented to your golf club or course on arrival. Failure to do so may result in the club or course refusing you entry. We shall not have any liability in these circumstances.
7. Amendments and Cancellations
7.1 All amendments to or cancellations of a Booking must be notified to us by the lead name by emailing us at firstname.lastname@example.org
7.2 If you wish to increase the number of players on your Booking, please contact us on 0808 178 0335 to arrange this with us. We will have to check this with the golf club or course to ensure that your original tee time is still available for the number of players you require. Once this is confirmed, we will take payment from you for the additional player(s) and will send you a revised Booking Confirmation.
7.3 If you wish to change the tee time or postpone the date of your tee time with the same golf club or course, we will try to arrange this for you subject to the availability of the tee time you request. Usually (but we cannot give a guarantee), the golf club or course will treat this as a postponement and not a cancellation of the booking and you will simply have to pay the difference between the price of your original Booking and the price of the new tee time. However, we charge an administration charge of £5 for handling these types of amendments.
7.4 If you wish to change the Booking to another golf club or course, this will be treated as a cancellation and new booking and the original golf club or course may charge you a cancellation fee. We will also charge you a £5 fee to cover our administration costs.
7.5 If any players included in your Booking wish to cancel, you (as lead name) must notify us as soon as possible before the start of your tee time. Depending on the terms of the golf club or course that apply to your Booking and the notice you give of the cancellation, you may be charged cancellation fees by the golf club or course. Generally, the more notice of cancellation you give before the date of your tee time, the lower the cancellation fees charged. In addition, we charge an administration fee of £5 per player cancellation.
7.6 If you cancel a Hot Deal Booking for any reason, or do not arrive on your specified date and time, your payment is non-refundable
7.7 All cancellation charges and administration fees are payable by the lead name on the Booking and we reserve the right to take payment for these from the credit or debit card you used to make payment for your Booking.
8. Our Liability
8.1 As agent for the sale of tee time bookings on behalf of the golf clubs and courses listed on our site, Teeofftimes.co.uk is not liable for any loss, claim, expense, damage or cost that you may incur as a result of the provision of any tee time by the golf clubs or courses listed on our site, or any other services provided by those golf clubs or courses, except to the extent caused by our negligence, fraud or fraudulent misrepresentation or by any other matter for which it would be illegal for us to exclude, or attempt to exclude, our liability. Please see our Important Golfing Extras page of our website regarding tee times and course playing conditions as well as the Inclement Weather policy which are incorporated into these Terms.
8.2 Without limitation to clause 9.1, we are not liable for any changes to your tee times or cancellations by the golf club or course as a result of any event or circumstance beyond the reasonable control of the golf club or course such as severe weather or other unusual or unforeseeable causes.
8.3 While we do our best to give you an informed view on the golf courses and clubs that we advertise on our site, we make no representations or warranties about the suitability of any of the golf courses or golf clubs with which you book your tee time.
8.4 We take all reasonable care to ensure our website is secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing our website.
9.1 As your contract for your tee time is between you and the golf club or course with whom you have made your Booking, any complaints should be addressed to the club or course. We advise you to make any complaints at the time the problem occurs in order to give the club or course an opportunity to rectify the situation. Delay in making a complaint may reduce your chances of receiving any compensation. If you should need assistance in relation to any complaint, please contact our Customer Services team on email@example.com or Customer Services at our main office address.
10. Written Communications
10.1 Applicable laws require that some of the information or communications we send to you should be in writing. When using our site, you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.
11.1 In order to process your booking request and to ensure that your Booking runs smoothly and meets your requirements, we need to use the personal information you provide such as name, address, telephone number, email address and payment details. We take full responsibility for ensuring that proper security measures are in place to protect your information and we will comply with the Data Protection Act 1998. In order to effect your booking, we must pass details of the lead name and contact telephone number to the golf club or venue in order to process your booking. The information may also be provided to security or credit checking companies, credit and debit card companies, regulatory or public authorities such as customs or immigration if required by them, or as required by law. This may involve sending your personal information between different countries, including countries outside the European Economic Area (EEA) where controls on data protection may not be as strong as the legal requirements in this country. This may also apply to any sensitive information that you give to us such as details of any disabilities or dietary/religious requirements. If we cannot pass your personal information on to the relevant suppliers, whether in the EEA or not, we cannot properly effect your booking. By providing us with your personal information, you consent to our use of that data as specified.
12. Our Right to Vary the Terms
12.1 We have the right to revise and amend the Terms from time to time and will publish the up-to-date terms on our website. You will be subject to the policies and terms and conditions in force at the time that you make a booking, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority (in which case it will apply to bookings previously made by you), or if we notify you of the change to those policies or these Terms before we send you the Booking Confirmation.
13. Law and Jurisdiction
13.1 These Terms are governed by Northern Ireland law and any disputes or claim arising out of or in connection with them shall be subject to the non-exclusive jurisdiction of the courts of Northern Ireland.
Important Golfing Extras
The following extra information has been compiled through our experience of booking tee times at UK golf clubs and courses and form part of our Terms of Business. Please read it carefully, as it will help to ensure that your expectations are met. However, please also read the rules of the course or club with whom you have booked a tee time.
1. Pace of Play
Golf courses are usually very busy in the high season and you should expect between a 4 and 4.5 hour round as a reasonable pace of play although this can be slower in extremely busy times. Pace of play cannot be guaranteed by the course.
2. Playing Conditions
Although golf courses are inspected on a regular basis, their actual playing condition may vary from time to time. Course maintenance such as aerating greens and improving drainage will happen from time to time and often will be scheduled at such short notice, depending on weather, which means that we are not always made aware of when this will occur. Equally, in particularly dry spells, when there are water bans in place, fairways and greens may be burnt and not in the best of playing conditions. Events such as these are out of the control of Teeofftimes.co.uk and the golf club or course and neither we nor the golf club or course can be held responsible for the condition of the course that you have booked to play.
3. Inclement Weather
As adverse weather is inevitable during the course of the year, golf clubs may either close the golf course or operate temporary tees and greens at their sole discretion. Please read our Inclement weather policy for further details.
4. Handicap Certificates
Some golf clubs or courses will require handicap certificates before accepting visitors, which we will endeavour to advise you of at the time of booking. Whilst a certificate of playing ability is not essential on all courses, the appropriate golfing etiquette and knowledge of golfing rules is expected and each golf course reserves the right to refuse access if it is judged that individuals do not display the required etiquette and/or knowledge. We cannot be held responsible in these circumstances.
5. Dress Code
Appropriate dress and footwear should be worn at all times on the course and in the clubhouse (as per the information included in your confirmation). Certain golf clubs have a dress code for dinner and this will be advised at the time of booking and in the extra notes on your booking confirmation. We cannot accept responsibility for any ruling by the club if you or any of your group is unable to play or dine due to inappropriate attire.
Most clubs reserve the right to refuse access to the course or the clubhouse if you behave without due consideration to other players. Refunds will not be payable in these circumstances.
You will be responsible directly to the golf club or course for any damage or loss to person or property that you cause and club rules normally require all damage to be paid for in full at the time that it occurs.
